第三十四條 國(guó)家支持和鼓勵(lì)社會(huì)組織或者個(gè)人向依法成立的獎(jiǎng)勵(lì)教師的基金組織捐助資金，對(duì)教師進(jìn)行獎(jiǎng)勵(lì)。
第八章 法律責(zé)任
第三十五條 侮辱、毆打教師的，根據(jù)不同情況，分別給予行政處分或者行政處罰；造成損害的，責(zé)令賠償損失；情節(jié)嚴(yán)重，構(gòu)成犯罪的，依法追究刑事責(zé)任。
Article 34 The State shall encourage and support social organizations and individuals to donate money to foundations established according to the law for awarding teachers.
Chapter VIII Legal Liability
Article 35 Anyone who insults or assaults a teacher shall be given an administrative sanction or penalty depending on the different circumstances; those who have caused losses or injury shall be ordered to compensate for the losses; and if the circumstances are serious enough to constitute a crime, the offender shall be investigated for criminal responsibility according to the law.
第三十六條 對(duì)依法提出申訴、控告、檢舉的教師進(jìn)行打擊報(bào)復(fù)的，由其所在單位或者上級(jí)機(jī)關(guān)責(zé)令改正；情節(jié)嚴(yán)重的，可以根據(jù)具體情況給予行政處分。國(guó)家工作人員對(duì)教師打擊報(bào)復(fù)構(gòu)成犯罪的，依照刑法第一百四十六條的規(guī)定追究刑事責(zé)任。
第三十七條 教師有下列情形之一的，由所在學(xué)校、其他教育機(jī)構(gòu)或者教育行政部門(mén)給予行政處分或者解聘。
Article 36 Anyone who retaliates against teachers who have made complaints, charges against or exposures of, any organization or individual in accordance with the law shall be ordered by his or her unit or by the authorities at a higher level to make a rectification; if the circumstances are serious, the offender may be given an administrative sanction in the light of the actual conditions.
State functionaries, who retaliate against teachers to such a degree as to constitute a crime, shall be investigated for criminal responsibility in accordance with the provisions of Article l46 of the Criminal Law.
Article 37 Teachers involved in any of the following circumstances shall be given administrative sanctions or dismissed by their schools, other institutions of education or administrative departments of education:
（一） 故意不完成教育教學(xué)任務(wù)給教育教學(xué)工作造成損失的；
（二） 體罰學(xué)生，經(jīng)教育不改的；
?。ㄈ?品行不良、侮辱學(xué)生，影響惡劣的。
(1) intentionally not accomplishing educational and teaching tasks and thus causing losses to educational and teaching work;
(2) imposing corporal punishments on students and refusing to mend their way after being criticized；
(3) having improper conduct and insulting students, thus making very bad impressions.
